Introduction
  1. Actionability, registered under the trade names of Actionability and Katalin Köbli Coaching & Business Performance Services, a sole proprietorship under Dutch law, with registered office in 2151CB Nieuw Vennep at Sportveldweg 77, attaches great importance to the responsible handling of personal data of users of its website www.actionability.nl and Actionability's Thinkific course pages (hereinafter “Users”).
  2. Actionability processes personal data of Users carefully and with due observance of the provisions laid down by the General Data Protection Regulation (GDPR).
  3. In this Privacy Statement, Actionability informs Users about the way Actionability processes their personal data and how they can change or object to it. This Privacy Statement only applies to the services offered by Actionability at www.actionability.nl.
Article 1: Explanation of personal data and purposes for the processing thereof

Personal data

  1. Actionability distinguishes between different types of Personal Data:
    (A) Communication data: Name and email address of a User, and resulting correspondence between Actionability and that User. Communication data may result from direct email contact, or through filling out a Sign-up Form or Contact Form, downloading content or signing up for the newsletter on www.actionability.nl.
    (B) Other data: Data not provided by the User. See article 5 of this statement for this.
  2. All Personal Data of a User is stored on Actionability’s managed WordPress storage hosted by GoDaddy as well as in Actionability’s email inbox.
  3. Actionability uses MailChimp as its email marketing tool for keeping track of client contact details as well as being able to measure marketing effectiveness. The Privacy Policy of MailChimp Contact can be read here.
  4. Actionability is at all times responsible for the management of the Personal Data provided by the User and will make every effort to protect those Personal Data. In the event of a data breach, Actionability will immediately notify the User of that event via the email address known to it and will make every effort to prevent further dissemination of that Personal Data.
  5. The User has the right at all times to have the Personal Data provided by him / her to Actionability presented in an orderly manner from Actionability (“right of inspection”). At the first request of a User, Actionability will forward his / her Personal Data to a third party to be designated by that User (“right to data portability”) or remove it entirely from its system (“right to be forgotten”).
  6. Any questions a user may have regarding their Personal Data can be sent to [email protected]. These questions will be answered within 2 working days.

    Legal Basis
  7. Because a User requests a service and provides personal data in categories A for this purpose, Actionability is authorised to use and process this personal data for the performance of the service in connection with which the personal data is provided as referred to in Article 6.1 (b) of the GDPR.
  8. The personal data will not be used for any other purpose than the purpose as stated in this statement, unless the User has given explicit consent for a different use of these Personal Data.

    Fraud, hacking and other malicious behaviour by users
  9. If necessary, Actionability will use data from Users to investigate or prevent fraud. Upon request, Actionability will hand over Personal Data as stated under 1.1 to the police, judicial authorities, and other investigative services or third parties involved, if it is obliged to do so by law, a court order, or if necessary to prevent criminal offence or unlawful behaviour.
Article 2: Transfer of data to third parties
  1. Actionability does not provide personal data to third parties, unless:
    a) The transfer is made to a third party engaged by Actionability for the purposes listed in this Privacy Statement, with which third parties Actionability has entered into an agreement that specifies how this Cooperation Partner handles your personal data in a responsible manner;
    b) Actionability is obliged by law to pass on personal data to competent authorities.
Article 3: Protection of data
  1. Actionability uses – as may be required of it – appropriate technical and organisational security procedures, among other things to ensure that unauthorised persons do not gain access to data and to prevent the loss, unlawful use or modification of the information Actionability receives.
Article 4: Availability and modification of data
  1. Users can at any time request access to their personal data that Actionability processes. Users can also request to have data changed or removed. For this, users can send an email to [email protected].
Article 5: Third party providers
  1. Actionability works with (or may in the future work with) analytics service providers and other vendors to provide us with information regarding traffic on our website and other channels, including pages viewed and the actions taken when visiting the service; to serve our advertisements on other websites, within mobile apps and elsewhere online; and to provide us with information regarding the use of our service and the effectiveness of our advertisements. Our service providers may collect certain information about your visits to and activity on the Service as well as other websites or services, they may set and access their own tracking technologies on your device (including cookies and web beacons), and may use that information to show you targeted advertisements. Some of these parties may collect personal information when you visit our online websites and services. We may also share certain non-identifying information with these parties, including hashed information, in connection with the services they provide to us.
Article 6: Liability Actionability
  1. This Privacy Statement only relates to the personal data that Actionability processes as mentioned in article 1.1. Actionability does not accept any responsibility or liability for (the operation and / or content of) websites or services of third parties.
Article 7: Change of Privacy Statement
  1. Actionability reserves the right to change this Privacy Statement. Any adjustment will be announced via www.actionability.nl. By using www.actionability.nl after the changes, you agree to any amended Privacy Statement. Keep an eye on this page for all changes.
